DMCA + takedown policy

Template language. The DMCA safe harbor in 17 U.S.C. 搂 512(c) requires a designated agent registered with the US Copyright Office. Before relying on this policy, register the agent at copyright.gov/dmca-directory ($6 filing fee). The placeholder email below should match the email on the agent registration.

What this page is for

can-nabis hosts user-submitted content across several surfaces: chat messages, Wall tags, Pro/Con timeline entries, community pins, grow-method submissions, photo gallery uploads, artist applications, and job board postings. If you believe any of that content infringes your copyright or is otherwise illegal, defamatory, or violates these terms, this is how to report it.

We respond to properly-formatted DMCA notices within a reasonable time, typically 1-3 business days. Improperly-formatted notices may take longer or be returned with a request for the missing elements.

What to include in a DMCA notice

17 U.S.C. 搂 512(c)(3) requires the following elements. Missing any of these may invalidate the notice:

  1. A physical or electronic signature of the copyright owner (or someone authorized to act on their behalf).
  2. Identification of the copyrighted work claimed to be infringed (URL or registration number).
  3. Identification of the material on can-nabis you want removed, with enough detail to find it (a direct URL is best).
  4. Your contact information: name, mailing address, phone, email.
  5. A statement that you have a good-faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
  6. A statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner.

Counter-notice

If your content was removed and you believe the removal was a mistake or misidentification, you can submit a counter-notice under 17 U.S.C. 搂 512(g). Counter-notices require:

  1. Your signature (physical or electronic).
  2. Identification of the material removed and the URL where it appeared.
  3. A statement under penalty of perjury that you have a good-faith belief the material was removed by mistake or misidentification.
  4. Your name, address, and phone number, and a statement consenting to the jurisdiction of the federal district court for your address (or, if outside the US, any district where can-nabis may be found).
  5. A statement that you will accept service of process from the original notice-sender.

We forward valid counter-notices to the original sender. If they do not file a lawsuit within 10-14 business days, we may restore the content.

Non-copyright takedown requests

For content that isn't a copyright issue but violates the terms of use (e.g. defamation, hate speech, harassment, unauthorized sales offers, dangerous medical advice), email hello@can-nabis.com with a description and a link. Moderation is at our discretion; we generally remove content that clearly violates terms.

Repeat infringer policy

We may suspend or terminate access for users who repeatedly post content that draws valid DMCA notices, consistent with 17 U.S.C. 搂 512(i).

False notices

Knowingly submitting a false DMCA notice is itself a violation of 17 U.S.C. 搂 512(f) and may result in liability for damages (including attorneys' fees) to the party whose content was wrongly removed.
