Adult-Use Cultivator (Tier 1 through Tier 5)
New York's Office of Cannabis Management (OCM) regulates cultivation under MRTA. Adult-Use Cultivator licenses are tiered by canopy size: Tier 1 (≤5,000 sq ft outdoor or 2,000 sq ft indoor) up through Tier 5 (≥100,000 sq ft outdoor or 30,000 sq ft indoor). New York's outdoor and mixed-light tiers are popular entry points; indoor remains energy-intensive and capital-heavy.
Pick canopy tier and method
Decide outdoor, mixed-light (greenhouse with supplemental lighting), or indoor, and the canopy tier. New York's growing season is shorter than CA/CO, so outdoor and greenhouse operators typically run one harvest cycle per year (some squeeze a second under mixed-light). Indoor operates year-round at higher cost. Tier 1 and Tier 2 are the most common entry points.

Check Social and Economic Equity (SEE) eligibility
MRTA targets 50% of all licenses for SEE applicants. SEE eligibility includes: justice-involved (you or immediate family with prior cannabis conviction), women-owned, minority-owned, distressed-farmer, service-disabled-veteran-owned. SEE applicants get priority review, fee waivers, and access to the Cannabis Social Equity Investment Fund (low-interest loans, real-estate support).

MRTA allowed every town and village to opt out of adult-use cannabis businesses by end of 2021. Roughly half opted out. You can only locate in a municipality that did NOT opt out OR that has since opted back in. OCM publishes the live opt-out list.

Secure compliant cultivation premises
Agricultural, industrial, or commercial-zoned site with: 500 ft setback from schools, 200 ft from churches, adequate water supply, electrical capacity for indoor/mixed-light. Outdoor sites with conserved-water access (especially in the Finger Lakes, Hudson Valley, and North Country) have been popular. New York is famously expensive for commercial real estate downstate; upstate is meaningfully cheaper.

Form a New York LLC or corporation through the Department of State. EIN. Cannabis-friendly banking: Valley National Bank, Needham Bank, and a handful of state-chartered credit unions are operating in NY. Banking fees run $1K-$3K/month.

Owner background checks + fingerprints
All true parties of interest with significant financial or operational control submit fingerprints and undergo OCM background and source-of-funds review. Cannabis convictions are explicitly not disqualifying under MRTA.

New York uses BioTrack as its track-and-trace system (not METRC). Every plant gets tagged at seedling, tracked through harvest, processing, and sale. Multi-session OCM training required.
